Kratom in Canada: Legal, Illegal, or Somewhere In Between?

In recent years, you’ve likely come across people endorsing kratom. You’ve also probably heard about its controversy. This herb is popular for its health benefits. But it's also illegal in some places. This makes its widespread use and potential benefits a complex issue. Where does that leave Canadian kratom users? Is kratom legal in Canada? Read below as we put those questions to rest. But first, let’s begin by demystifying this medicinal herb.

What is Kratom?

Kratom is a tropical evergreen tree. It has garnered significant interest for its diverse healing properties. Most people consume kratom for pain relief. The plant abounds in potent alkaloids. These soothe the pain. They attach to various opioid receptors in the brain. 


This herb stimulates brain function. It may also help with mental health disorders. Some include anxiety, depression, and mood swings. Besides, some research indicates the herb might help to manage opioid withdrawal symptoms. 


Kratom’s unending list of medical benefits is extensive. It originates in Southeast Asia. But the Western world has adopted it too. Canadians want to integrate this herb into their lifestyle. The big question remains – Is kratom legal in Canada? The following sections shall expound further on that. 




Kratom isn't mentioned in Canadian law. This is because it's pretty new. Scientists are still researching its effects. Since it's not banned, kratom is legal in Canada. You can possess and use it.


Kratom has the potential to help with opioid withdrawal. So, it could be critical in addressing Canada's opioid crisis. However, more research is needed to fully understand its efficacy in overcoming this addiction.

What is Health Canada’s Perception of Kratom?


Health Canada is Canada’s principal drug enforcement agency. This regulates the manufacture and distribution of medicines. Health Canada has yet to recognize kratom’s benefits. So, the agency doesn’t authorize drugs with kratom-based compounds. 


Health Canada has previously recalled certain kratom brands. They did that for gross violation of its quality control measures. So, vendors must actively comply with existing kratom regulations. To stay legal, avoid saying kratom products do treat medical conditions. You can label them "for research only" and clearly state any known risks.



Delving Into the CFIA’s Restrictions On Kratom


In Canada, the Canadian Food Inspection Agency (CFIA) oversees the safety of food products. Since people often consume kratom, the CFIA technically regulates it.

Like Health Canada, the CFIA doesn’t impose outright bans on kratom. But the agency doesn’t recognize the herb either. This means kratom stores should sell it in non-edible forms, like oils or creams.


The Canadian Food Safety Agency rarely checks kratom quality. But stores still need to find ways around the rules. One way to legally sell it is to offer it as a ‘giveaway.’ Shops add kratom to a package containing other wellness products.



Should Consumers Worry?


Canadian kratom users have little to worry about. First, most restrictions target kratom vendors. And even so, these governing hurdles are easy to overcome. So consumers can purchase it without violating the law. The only exception would be if you’re looking for kratom-based e-juices. In this case, vaping laws would apply. 


You must be of legal age to buy vape products in Canada. That age is 18 in Alberta, Ontario, Manitoba, Quebec, Prince Edward Island, and Saskatchewan. It's 19 in the rest of Canada. British Columbia, New Brunswick, Newfoundland, Labrador, Nova Scotia, and the three territories. Vape oils must contain at least cannabis or nicotine. Kratom vape juice without this doesn't have a regulation.



Can I Grow Kratom In Canada?

Kratom is legal to cultivate in Canada. But it's not easy to achieve optimal yields. You must replicate the natural conditions in the herb’s native range. Kratom thrives within a temperature range of 75 – 95 degrees Fahrenheit. The plant prefers extended sunshine and regular watering. As for the humidity, aim for relative humidity levels of 50 – 70%.



Final Word


Kratom is legal in Canada for use and possession. There are no explicit laws banning the plant. But, vendors must comply with Health Canada and the CFIA’s regulations. This is true both for kratom packaging and marketing.
